MapBox provides a suite of open source tools and services for creating and using custom maps in the cloud.

MapBox's TileMill toolkit is a fully configured open source tile rendering engine that can be used to create custom maps using any data set, whether your private data or freely available public sources. MapBox.com also makes large public data sets available for easy access and use. Combining TileMill and these data sets together, MapBox provides the framework that we use to make some of the most beautiful custom maps in the world.

In addition to these tools and data, MapBox also provides several custom-designed base maps – or "tilesets" – for free use by the public. These tiles can be integrated into your website using Google Maps, Open Layers, and other map browsers, including our Maps on a Stick browser that lets you view maps and data without an internet connection. For large scale users, we also offer a high availability SLA so that our tiles can be used with confidence in mission-critical applications and websites. For these same users, we also offer custom design and consulting services.

In addition to maintaining TileMill, public data sets, and hosting public map tiles, our team provides consulting and custom map design services to help organizations get the most out of MapBox.

Custom map design

Our goal is to make data more actionable through design. Beyond great visual design, we work to help organizations better communicate with maps. Our maps can be used internally behind a firewall for intranets and other private services like we have done with the World Bank, or hosted in the cloud with a custom SLA to power public facing campaigns sites like we have done for the UN World Food Programme. They can also be used offline for operations in the field, thanks to Maps on a Stick.

Sharing large GIS datasets is becoming increasingly popular as organizations realize the potential for networking to improve their work, whether for crisis response or better business practice. Doing so can be difficult, with complex user needs and technical problems to address in order to create successful open data projects. The fine print from the lawyers

BY USING THE MAPBOX SITE YOU ACKNOWLEDGE THAT YOU HAVE READ, UNDERSTOOD, AND AGREE TO BE BOUND BY THE FOLLOWING TERMS OF SERVICE AND ANY FUTURE MODIFICATIONS TO THIS AGREEMENT (COLLECTIVELY, THE "TERMS"). IF AT ANY TIME YOU DO NOT AGREE TO THESE TERMS, PLEASE IMMEDIATELY TERMINATE YOUR USE OF THE MAPBOX SITE. YOU, ON YOUR OWN BEHALF AND ON BEHALF OF YOUR COMPANY, ACKNOWLEDGE THAT THESE TERMS ARE BINDING AND ENFORCEABLE ON YOU AND YOUR COMPANY. MAPBOX IS A PRODUCT AND SERVICE OFFERED BY DEVELOPMENT SEED, INC. d/b/a/ MAPBOX.

In addition, when using some MapBox services, you shall be subject to any guidelines or rules applicable to such services that may be posted from time to time. All such guidelines or rules are hereby incorporated by reference into these Terms.

MapBox Site means all software, services, maps and other content made available at www.mapbox.com, including any corrections, enhancements and updates incorporated in the future.

Amendment of these Terms. MapBox reserves the right, at its sole discretion, to modify, add, or delete portions of or otherwise change these Terms at any time without notice to you by posting the changed Terms on the MapBox Site. All changes shall be effective immediately upon posting. Please check these Terms periodically for changes. Your continued use of the MapBox Site after the posting of changes constitutes your binding acceptance of such changes.

License; Restrictions. MapBox grants you permission to use the MapBox Site, including its services and content, as set forth in these Terms, provided that and for so long as you do not reproduce, retransmit, publish, resell, distribute, publicly display or otherwise exploit any portion of the MapBox Site, including all maps and other content generated by the MapBox Site, in any medium without MapBox's prior written authorization.

Your Obligations

(a) Compliance. As a condition of your use of the MapBox Site, you warrant to MapBox that you will not use the MapBox Site for any purpose that is unlawful or prohibited by these terms, conditions, or notices. You may not use the MapBox Site in any manner which could damage, disable, overburden, or impair the MapBox Site or interfere with any other party's use and enjoyment of the MapBox Site. Recognizing the global nature of the Internet, you agree to comply with all local rules regarding online conduct and acceptable content.

(b) Unacceptable Use. You are solely responsible for any and all acts and omissions that occur under your account or password, and you agree not to engage in unacceptable use of the MapBox Site, which includes, without limitation, use of the MapBox site to: (i) disseminate or transmit material that, to a reasonable person, may be abusive, obscene, pornographic, defamatory, harassing, grossly offensive, vulgar, threatening or malicious; (ii) disseminate, store or transmit files, graphics, software or other material that actually or potentially infringes the copyright, trademark, patent, trade secret or other intellectual property right of any person; (iii) create a false identity or to otherwise attempt to mislead any person as to the identity or origin of any communication; (iv) export, re-export or permit downloading of any content in violation of any export or import law, regulation or restriction of the United States and its agencies or authorities, or without all required approvals, licenses or exemptions; (v) interfere, disrupt or attempt to gain unauthorized access to other accounts or any other computer network; (vi) disseminate, store or transmit viruses, trojan horses or any other malicious code or program; or (vii) engage in any other activity deemed by MapBox to be in conflict with the spirit or intent of these Terms.

(c) Indemnification. You agree to indemnify and hold harmless MapBox and its subsidiaries, affiliates, officers, agents, partners, and employees from any claim or demand, including reasonable attorneys' fees, made by any third party due to or arising out of content you submit, post to, or transmit through the MapBox Site, your use of the MapBox Site, your violation of these Terms, or your violation of any rights of another.

MapBox Maps and Other Content. MapBox and its designees shall have the right (but not the obligation) in their sole discretion to refuse to post or remove any maps or other content that is available on the MapBox Site, in whole or in part, at any time for any reason or no reason, with or without notice and with no liability of any kind. From time to time, the MapBox Site, including its software, services, maps and other content, may be updated, such as the incorporation of bug fixes, patches, enhanced functions, new plug-ins, new versions and other such updates. By using the MapBox Site, you agree to automatically request and receive such updates.

The MapBox Site’s maps and other content are owned and/or licensed by MapBox.

MapBox Content. The MapBox Site allows you to access and view a variety of content, including but not limited to photographic imagery, map and terrain data and other related information provided by MapBox and its licensors. Additionally, you may choose to access other third party content made available on the MapBox Site through ManaginNews. You understand and agree to the following with respect to all content made available by or through the MapBox Site: (a) Map data and related content are provided for planning purposes only. You may find that events may cause the actual information to differ from the map results. You should exercise judgment in your use of all content made available by or through the MapBox Site.

(b) These Terms do not constitute a sale of the software or any copy of the software. By using the MapBox Site, you do not receive or acquire any proprietarty right s therein, and MapBox and/or its licensors retain all ownership rights in the MapBox Site and its content. You may not use, access or allow others to use or access the content in any manner not permitted under the Terms, unless you have been specifically permitted to do so by MapBox or by the owner of that content, in a separate agreement.

(c) Certain content is provided under license from third parties, and is subject to copyright and other intellectual property rights owned by or licensed to such third parties. You may be held liable for any unauthorized copying or disclosure of this content. You understand that when using the MapBox Site you will be exposed to user submissions and other third party content from a variety of sources (“Non-MapBox Content”), and that you may be exposed to Non-MapBox Content that is inaccurate, offensive, indecent, or otherwise objectionable. MapBox does not endorse any Non-MapBox Content or any opinion, recommendation, or advice expressed therein. Under no circumstances will MapBox be liable in any way for or in connection with the Non-MapBox Content, including, but not limited to, for any inaccuracies, errors or omissions in any Non-MapBox Content, any intellectual property infringement with regard to any Non-MapBox Content, or for any loss or damage of any kind incurred as a result of the use of any Non-MapBox Content posted, emailed or otherwise displayed or transmitted through the MapBox Site.

(d) MapBox reserves all rights not expressly granted to you. The use of the MapBox Site, including its software, services, maps and other content, is licensed only to you and may not be transferred to anyone without the prior written consent of MapBox. Any authorized transferee shall agree in writing to be bound by the terms and conditions of these Terms. In no event may you copy, loan, rent, time-share, sublicense, assign, transfer, lease, sell or otherwise dispose of the Mapbox Site’s software, maps or other content on a temporary or permanent basis except as expressly provided herein. These Terms shall benefit MapBox and its successors and assigns. You may not, or permit any third party to, modify, adapt, translate, create derivative works from, reverse engineer, decompile, disassemble or otherwise attempt to derive any source code from the MapBox Site’s software. All logos and product names appearing on or in connection with the MapBox Site are proprietary to MapBox or its licensors and/or suppliers. You agree never to remove any proprietary notices or product identification labels from the MapBox Site’s software, maps and other content, if applicable. The limited license granted above terminates automatically, without notice to you, if you breach any of these Terms. Upon termination of the limited license, you agree to immediately destroy any downloaded or printed materials from the MapBox Site, including software, maps and other content.

CERTAIN JURISDICTIONS DO NOT ALLOW LIMITATIONS ON IMPLIED WARRANTIES OR THE EXCLUSION OR LIMITATION OF CERTAIN DAMAGES. IF YOU RESIDE IN SUCH A JURISDICTION, SOME OR ALL OF THE ABOVE DISCLAIMERS, EXCLUSIONS, OR LIMITATIONS MAY NOT APPLY TO YOU, AND YOU MAY HAVE ADDITIONAL RIGHTS. THE LIMITATIONS OR EXCLUSIONS OF WARRANTIES, REMEDIES, OR LIABILITY CONTAINED IN THESE TERMS APPLY TO YOU TO THE FULLEST EXTENT SUCH LIMITATIONS OR EXCLUSIONS ARE PERMITTED UNDER THE LAWS OF THE JURISDICTION IN WHICH YOU ARE LOCATED.

MAPBOX DISCLAIM ALL WARRANTIES IN CONNECTION WITH THE CONTENT AND THE PRODUCTS, AND WILL NOT BE LIABLE FOR ANY DAMAGE OR LOSS RESULTING FROM YOUR USE OF THE CONTENT OR THE PRODUCTS.

Disclaimers; No Warranties (a) Acknowledgement. YOU EXPRESSLY ACKNOWLEDGE THAT THE TERM MAPBOX INCLUDES DEVELOPMENT SEED, INC. AND THE OFFICERS, DIRECTORS, EMPLOYEES, SHAREHOLDERS, AGENTS, AFFILIATES, AND SUBCONTRACTORS OF DEVELOPMENT SEED, INC.

(b) "As Is,"As Available" and "With All Faults." YOU EXPRESSLY AGREE THAT THE USE OF THE MAPBOX SITE IS AT YOUR SOLE RISK. THE MAPBOX SITE AND ITS SOFTWARE, SERVICES. MAPS AND OTHER CONTNET, INCLUDING ANY THIRD-PARTY SOFTWARE, SERVICES, MEDIA OR OTHER CONTENT MADE AVAILABLE IN CONJUNCTION WITH OR THROUGH THE MAPBOX SITE, ARE PROVIDED ON AN "AS IS" "AS AVAILABLE", "WITH ALL FAULTS" BASIS AND WITHOUT WARRANTIES OR REPRESENTATIONS OF ANY KIND, EITHER EXPRESS OR IMPLIED.

(c) No warranties. TO THE FULLEST EXTENT PERMISSIBLE PURSUANT TO APPLICABLE LAW, MAPBOX DISCLAIMS ALL WARRANTIES, STATUTORY, EXPRESS OR IMPLIED, INCLUDING, BUT NOT LIMITED TO, IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE, AND NON-INFRINGEMENT OF PROPRIETARY RIGHTS. NO ADVICE OR INFORMATION, WHETHER ORAL OR WRITTEN, OBTAINED BY YOU FROM MAPBOX OR THROUGH THE MAPBOX SITE, WILL CREATE ANY WARRANTY NOT EXPRESSLY STATED HEREIN.

(d) Website Operation and Non-MapBox Content. MAPBOX DOES NOT WARRANT THAT THE MAPBOX SITE, INCLUDING ANY SOFTWARE, SERVICES, MAPS OR CONTENT OFFERED ON OR THROUGH THE MAPBOX SITE OR ANY THIRD PARTY SITES REFERRED TO ON OR BY THE MAPBOX SITE WILL BE UNINTERRUPTED, OR FREE OF ERRORS, VIRUSES, OR OTHER HARMFUL COMPONENTS AND DOES NOT WARRANT THAT ANY OF THE FOREGOING WILL BE CORRECTED.

(e) Accuracy. MAPBOX DOES NOT WARRANT OR MAKE ANY REPRESENTATIONS REGARDING THE USE OR THE RESULTS OF THE USE OF THE MAPBOX SITE OR ANY THIRD PARTY SITES REFERRED TO ON OR BY THE MAPBOX SITE IN TERMS OF CORRECTNESS, ACCURACY, RELIABILITY, OR OTHERWISE.

(f) Harm to Your Computer. YOU UNDERSTAND AND AGREE THAT YOU USE, ACCESS, DOWNLOAD, OR OTHERWISE OBTAIN SOFTWARE, SERVICES, MAPS OR CONTENT THROUGH THE MAPBOX SITE (INCLUDING RSS FEEDS) OR ANY THIRD PARTY SITES REFERRED TO ON OR BY THE MAPBOX SITE AT YOUR OWN DISCRETION AND RISK AND THAT YOU WILL BE SOLELY RESPONSIBLE FOR ANY DAMAGE TO YOUR PROPERTY (INCLUDING YOUR COMPUTER SYSTEM) OR LOSS OF DATA THAT RESULTS FROM SUCH DOWNLOAD OR USE.

Limitation of Liability and Damages (a) Limitation of Liability. UNDER NO CIRCUMSTANCES, AND UNDER NO LEGAL THEORY, INCLUDING, BUT NOT LIMITED TO, NEGLIGENCE, SHALL MAPBOX OR ITS AFFILIATES, CONTRACTORS, EMPLOYEES, AGENTS, OR THIRD PARTY PARTNERS OR SUPPLIERS, BE LIABLE FOR ANY SPECIAL, INDIRECT, INCIDENTAL, CONSEQUENTIAL, OR EXEMPLARY DAMAGES (INCLUDING WITHOUT LIMITATION, LOSS OF PROFITS, DATA OR USE OR COST OF COVER) ARISING OUT OF OR RELATING TO THESE TERMS OR THAT RESULT FROM YOUR USE OR THE INABILITY TO USE THE MAPBOX SITE, INCLUDING SOFTWARE, SERVICES. MAPS, CONTENT, USER SUBMISSIONS OR ANY THIRD PARTY SITES REFERRED TO ON OR BY THE MAPBOX SITE, EVEN IF MAPBOX OR A MAPBOX AUTHORIZED REPRESENTATIVE HAS BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.

(b) Limitation of Damages. IN NO EVENT SHALL THE TOTAL LIABILITY OF MAPBOX OR ITS AFFILIATES, CONTRACTORS, EMPLOYEES, AGENTS, OR THIRD PARTY PARTNERS, LICENSORS OR SUPPLIERS TO YOU FOR ALL DAMAGES, LOSSES, AND CAUSES OF ACTION ARISING OUT OF OR RELATING TO THESE TERMS OR YOUR USE OF THE MAPBOX SITE (WHETHER IN CONTRACT, TORT (INCLUDING NEGLIGENCE), WARRANTY, OR OTHERWISE) EXCEED THE GREATER OF ONE HUNDRED DOLLARS ($100 USD) OR FEES PAID IN THE PRECEDING TWELVE (12) MONTHS.

(c) Reference Sites. THESE LIMITATIONS SHALL ALSO APPLY WITH RESPECT TO DAMAGES INCURRED BY REASON OF ANY PRODUCTS OR SERVICES SOLD OR PROVIDED ON ANY THIRD PARTY SITES REFERRED TO ON OR BY THE MAPBOX SITE OR OTHERWISE BY THIRD PARTIES OTHER THAN MAPBOX AND RECEIVED BY YOU THROUGH OR ADVERTISED ON THE MAPBOX SITE OR RECEIVED BY YOU THROUGH ANY THIRD PARTY SITES.

(d) Claim Period. YOU AND MAPBOX AGREE THAT ANY CAUSE OF ACTION ARISING OUT OF THESE TERMS OR RELATED TO MAPBOX MUST COMMENCE WITHIN ONE (1) YEAR AFTER THE CAUSE OF ACTION ACCRUES. OTHERWISE, SUCH CAUSE OF ACTION IS PERMANENTLY BARRED.

Digital Millennium Copyright Act Compliance. If you are a copyright owner or an agent thereof, and believe that any user submission or other MapBox content infringes upon your copyrights, you may submit a notification pursuant to the Digital Millennium Copyright Act ("DMCA") by providing our Copyright Agent with the following information in writing (see 17 U.S.C § 512(c)(3) for further detail): (i) A physical or electronic signature of a person authorized to act on behalf of the owner of an exclusive right that is allegedly infringed;

(ii) Identification of the copyrighted work claimed to have been infringed, or, if multiple copyrighted works on MapBox are covered by a single notification, a representative list of such works from MapBox;

(iii) Identification of the material that is claimed to be infringing or to be the subject of infringing activity and that is to be removed or access to which is to be disabled, and information reasonably sufficient to permit MapBox to locate the material;

(iv) Information reasonably sufficient to permit MapBox to contact the complaining party, such as an address, telephone number, and, if available, an electronic mail address;

(v) A statement that the complaining party has a good faith belief that use of the material in the manner complained of is not authorized by the copyright owner, its agent, or the law; and

(vi) A statement that the information in the notification is accurate, and under penalty of perjury, that the complaining party is authorized to act on behalf of the owner of an exclusive right that is allegedly infringed.

Additional Terms. These Terms shall be governed by and construed in accordance with the laws of Washington, D.C., without giving effect to any principles of conflicts of law. You agree that any action at law or in equity arising out of or relating to these Terms or MapBox shall be filed only in the District of Colombia or federal courts in and for Washington DC and you hereby consent and submit to the exclusive personal jurisdiction and venue of such courts for the purposes of litigating any such action. A provision of these Terms may be waived only by a written instrument executed by the party entitled to the benefit of such provision. The failure of MapBox to exercise or enforce any right or provision of these Terms will not constitute a waiver of such right or provision. If any provision of these Terms shall be unlawful, void, or for any reason unenforceable, then that provision shall be deemed severable from these Terms and shall not affect the validity and enforceability of any remaining provisions. You agree that no joint venture, partnership, employment, or agency relationship exists between you and MapBox as a result of these Terms or use of MapBox. You further acknowledge no confidential, fiduciary, contractually implied or other relationship is created between you and MapBox other than pursuant to these Terms.

While MapBox map tiles are available for free use under our standard Terms of Service, we also offer a premium Service Level Agreement (SLA) to organizations who want the most from MapBox.

The fee for premium service is $125/month with an annual contract. Please contact info@mapbox.com regarding service.

** Note: Depending on the data used to create the tiles, other attributions, particularly for OpenStreetMap, may still required, and can be made with a simple light gray text attribution.

Our guarantee

We guarantee that the MapBox service will be available 99.9% of the time every month of your use of the service. If we do not meet this guarantee, you will be eligible to receive a Service Credit as described below.

Defining unavailability

For MapBox service, unavailability means:

• (i) MapBox map tiles are down and inaccessible, or
• (ii) MapBox service returns a server error response to a valid user request during two or more consecutive 90 second intervals, or
• (iii) MapBox map tiles are not delivered in an average download time of 2 seconds per tile.

Unavailability due to scheduled maintenance is excluded from these conditions and does not contribute towards unavailability calculations.

Service Credits

Service Credits are calculated as a percentage of the total charges paid by you for MapBox each month, or your annual fee divided by 12, as follows:

To receive a credit, you must contact MapBox within thirty (30) days following the end of the unavailability via email at info@mapbox.com and include the dates and times of each incident of unavailability and your server request logs that document the errors and corroborate your outage (any confidential information may be removed). If the percentage of uptime applicable to the month of such as request is confirmed by us to be below 99.9%, we will issue you the Service Credit.

This Service Level Guarantee is your sole and exclusive remedy for MapBox unavailability.

Limitations

You are not entitled to a credit if (i) you are in breach of your services agreement with MapBox (including your payment obligations to us), or if unavailability is caused by factors (ii) outside of our reasonable control, including any force majeure event or internet access or related problems beyond the services of MapBox, (iii) resulting from actions or inactions of you or any third party, and (iv) resulting from your equipment, software or other technology and/or third party equipment, software or other technology that is not within our direct control.

MapBox has a special terms of service in place with the United States General Services Administration so that MapBox service can be easily procured for US federal .gov projects through Apps.gov. All that federal agencies who want to use MapBox tiles need to do to start the process is go to Apps.gov and enroll. (Direct links aren't supported, look under "Social Media Apps" >> "Display of Multimedia, Data, Maps")

Trademarks

MapBox (TM) and the MapBox logo (shown below), are trademarks and service marks of Development Seed, and you may not call your products or services "MapBox."

You can, of course (and you'd make our day if you did), say that your product is based on MapBox, inspired by MapBox, and so on, but you can't call your product or service MapBox.

Attribution

Our tiles may be used freely in accordance with the Terms of Service and with proper attribution. Please find details on how to properly attribute Mapbox tilesets here.
